The long-running dispute between SES and Intelsat over how the FCC’s C-band payments have been allocated has prompted SES to ask Intelsat’s Bankruptcy Court to hold a hearing in April.
The hearing, if granted, will be heard and mediated by Judge Mark Colombell in Virginia.
“SES believes that a hearing would be beneficial to address the various issues raised by the remand. SES understands that [Intelsat] does not believe a hearing is necessary, but will participate in one if the Court believes it would be helpful,” says the SES submission.
Judge Colombell has requested that the parties attend an in-person mediation in Richmond in April, and suggesting that this mediation could take place the day after (or before, says the filing) any oral argument on the remand so as to save the parties from having to travel to Richmond twice.
Intelsat’s Bankruptcy Court issued its verdict, essentially in Intelsat’s favour in September 2022. This led to an appeal by SES to the US District Court for the Eastern District of Virginia on October 14th 2022. This then opened up further arguments from both parties last year with Intelsat filing its -currently final – document into the Court on January 12th 2024.
